Owners.ge Terms & Conditions

These Terms and Conditions govern the use of the website — Owners.ge — including user registration, posting listings, the use of photos, texts and other content, as well as the operation of the platform.

By entering the Owners.ge website, creating an account, posting a listing or using the platform in any form, the user confirms that they have read these terms, agree to them and accept the rights and obligations set out herein.

1. Purpose of the platform

1.1.Owners.ge is an online platform whose purpose is to connect real estate owners, buyers, tenants and other interested parties with one another.

1.2.Owners.ge is not a real estate agency, broker, intermediary or party to any transaction and does not conclude transactions on users' behalf.

1.3.Owners.ge does not participate in negotiations, agreements, payments or other contractual relationships between users.

2. User registration and obligations

2.1.When creating an account, the user is obliged to provide accurate, complete and up-to-date information.

2.2.The user is responsible for protecting their account, password and authorization data, as well as for all actions carried out from their account.

2.3.The user is prohibited from:

  • creating an account in another person's name or with false data;
  • sharing account data with third parties;
  • circumventing the platform's security mechanisms;
  • using the platform for unlawful, fraudulent or other prohibited purposes.

2.4.A listing may only be posted by a user who is the owner of the respective real estate and who, in accordance with applicable law, may carry out actions related to that property.

3. Listing rules

3.1.Each listing must be:

  • real;
  • accurate;
  • compliant with applicable law;
  • published directly by the owner of the real estate.

3.2.The price, photos, address, area, condition, description and other information in a listing must correspond to the actual state of the property.

3.3.The user is fully responsible for the content, accuracy and legality of the listing they publish and for the protection of third parties' rights.

3.4.The following are prohibited:

  • posting fake or misleading listings;
  • publishing the same listing repeatedly;
  • keeping a non-existent or already sold/rented-out property actively offered;
  • posting listings for services, advertising or other non-real-estate content;
  • stating information about a property that the user knows, for any reason, to be incorrect;
  • publishing a listing in the owner's name by an agency, broker or other person.

4. Direct contact and transactions

4.1.Owners.ge facilitates direct communication between owners and interested parties.

4.2.All negotiations, agreements, payments, contract conclusion, property handover, rental, purchase and sale and other transactions are carried out directly between the respective parties.

4.3.Owners.ge is not responsible for:

  • the terms of agreements reached between the parties;
  • payments;
  • performance or non-performance of a transaction;
  • the legal status of the property;
  • the accuracy of information provided by users;
  • damage caused by users' actions.

4.4.Users are obliged to act towards one another in good faith, with respect and in accordance with applicable law.

5. Prohibited content and actions

  • publishing fake, fraudulent or misleading information;
  • indicating a contact phone number in the listing description directly, indirectly, split into parts or in any other form. A contact number may only be provided through the relevant functionality offered by the Owners.ge platform;
  • posting discriminatory, threatening, offensive or hate-containing content;
  • promoting unlawful activity;
  • infringing someone's copyright, related rights, trademark, privacy or other rights;
  • unauthorized use of someone else's photos, texts, descriptions or other material;
  • spam, automated messaging or abuse of the platform's functions;
  • damaging the platform's technical infrastructure;
  • automatically extracting, copying or commercially using the platform's data without Owners.ge's prior written consent.

6. Rights to photos, texts and other content

6.1.The user confirms and guarantees that they hold the respective rights to the photos, texts, descriptions, graphic materials and other content uploaded to the platform and that posting them does not infringe third parties' rights.

6.2.Copyright or other ownership rights to content uploaded by the user do not automatically transfer to Owners.ge, except where otherwise specified in a separate written agreement between the parties.

6.3.By uploading content, the user grants Owners.ge a non-exclusive, worldwide, royalty-free right, for the purposes of the platform's operation, advertising, promotion, technical processing, formatting, resizing, thumbnail creation and display to users, to:

  • store it;
  • process it;
  • reproduce it;
  • display it publicly;
  • technically transform it;
  • use it on the platform's website, mobile version, social networks, and advertising and information materials.

6.4.This right applies to the extent and for the duration necessary for the platform's operation and the respective listing's service, while advertising or archiving use may continue within reasonable limits, in accordance with applicable law.

6.5.The user is prohibited, without Owners.ge's prior written consent, from performing the following with the photos, texts, descriptions, design elements, data structure or other content placed on Owners.ge:

  • downloading;
  • copying;
  • extracting by technical means;
  • reproducing;
  • processing;
  • commercial use;
  • transferring to third parties;
  • placing on another website, platform, social network, listings site or advertising channel.

6.6.The logo, branding, design, software code, interface, data structure, texts, functional elements of the platform and other own-created materials used by Owners.ge constitute the intellectual property of Owners.ge or the respective rights holder and are protected by applicable law.

6.7.Use of the Owners.ge name, logo, photos, listings, texts or other content is permitted only with Owners.ge's prior written consent or in cases directly permitted by law.

6.8.Violation of the prohibitions set out in this article may result in:

  • deletion of the respective material;
  • restriction, suspension or termination of the account;
  • sending a notice about the violation to the respective platform;
  • a claim for compensation of damage;
  • the use of legal mechanisms to protect copyright and other intellectual property rights;
  • administrative, civil or criminal liability, where the specific action entails such liability under applicable law.

6.9.Owners.ge reserves the right, in suspected cases of rights infringement, to demand the deletion, discontinuation or blocking of the respective material and to cooperate with authorized bodies within the limits of applicable law.

7. Verification

7.1."Verified Owner" means that the user has submitted the requested documents to Owners.ge and the platform has carried out the respective review.

7.2.Verification is not a guarantee of:

  • successful completion of a transaction;
  • the legal cleanliness of the property;
  • final confirmation of rights to the property in all possible aspects;
  • the technical or actual condition of the property;
  • the user's future actions;
  • the complete accuracy of all information stated in the listing.

7.3.Before any transaction, the user must independently verify the legal, factual and financial condition of the property.

7.4.Public display of the phone number — the user is informed that once they are granted the “Verified Owner” status, the contact phone number stated on their active listings will be displayed publicly on the Owners.ge platform and will be accessible to listing viewers for the purpose of contacting them directly.

8. Limitation of liability

8.1.Owners.ge operates as an online platform and is not a party to transactions, a real estate expert, legal advisor, valuation specialist or financial intermediary.

8.2.To the maximum extent permitted by law, Owners.ge is not responsible for:

  • the accuracy of information published by the user;
  • the authenticity or currency of a listing;
  • users' actions or omissions;
  • the consequences of transactions between parties;
  • cases of payment, fraud, damage or dispute;
  • temporary unavailability of the platform;
  • actions carried out on a third party's website or service.

8.3.The user is obliged to independently verify important information, documents, ownership rights and transaction terms.

9. Account suspension and deletion

9.1.Owners.ge is entitled, with prior or subsequent notice, within the limits of applicable law, to:

  • suspend or restrict an account;
  • delete a listing or content;
  • revoke a user's access;
  • request additional information or a document;
  • take security or preventive measures.

9.2.The said measures may be applied if the user:

  • violates these terms;
  • posts prohibited or unlawful content;
  • provides fake or misleading information;
  • infringes third parties' rights;
  • creates a security, fraud or platform-abuse risk.

9.3.Suspension or deletion of an account does not exclude Owners.ge's right to resort to legal mechanisms to protect against damage caused by the violation or to defend its rights.

10. Updates to the terms

10.1.Owners.ge is entitled to periodically change or update these terms.

10.2.The updated version will be published on this page and, where necessary, the user will be provided with the respective notice.

10.3.Continued use of the platform after an update of the terms means agreement to the updated terms, except where applicable law requires additional consent from the user.

12. Governing law

These terms are governed by the applicable legislation of Georgia. Any dispute related to the use of the platform shall be considered in accordance with the procedure established by the legislation of Georgia.
